1. Acceptance of Terms
Welcome to the official website of Flishrc (“Site”). Flishrc provides all its services to you strictly in accordance with the notices, terms, and conditions set forth in this Agreement (“Agreement”).
In addition, your use of any specific Flishrc service (e.g., Customer Reviews) shall be governed by the corresponding rules, guidelines, policies, terms, and conditions applicable to such service. All these supplementary provisions are incorporated into this Agreement by reference and shall have the same legal effect as this Agreement.
Flishrc reserves the unconditional right to modify the content of this Site and these terms and conditions at any time, without prior notice. Your continued access to or use of the Site following any such modifications constitutes your acceptance of the revised Agreement.
IMPORTANT NOTICE: Accessing, browsing, or otherwise using this Site signifies your unreserved agreement to all the terms and conditions contained in this Agreement. Please read this Agreement carefully before using any function of the Site.
2. Site Usage Rules
2.1 Eligibility and License Grant
You represent and warrant that you are at least 18 years of age, or are accessing the Site under the direct supervision of a parent or legal guardian.
Subject to the terms and conditions of this Agreement, Flishrc hereby grants you a revocable, non-transferable, and non-exclusive license to access and use the Site via an internet browser. This license is limited solely to the purpose of purchasing personal consumer items sold on the Site. Commercial use, or use on behalf of any third party, is strictly prohibited unless explicitly authorized in writing by Flishrc in advance.
Any breach of this Agreement will result in the immediate revocation of the license granted in this section, without prior notice to you.
2.2 Prohibited Activities
Except as expressly permitted in Section 2.1, you shall not, without Flishrc’s prior written consent:
- Reproduce, distribute, display, sell, lease, or transmit the Site or any portion thereof;
- Create derivative works based on the Site, or translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit the Site or any of its components;
- Use any information provided on the Site for commercial purposes, or utilize the Site to benefit any third-party business.
Flishrc reserves the sole discretion to refuse service, terminate user accounts, and/or cancel orders. This right may be exercised if Flishrc reasonably believes that a customer’s conduct violates applicable laws, regulations, or is detrimental to Flishrc’s legitimate interests, including but not limited to reputational harm and financial loss.
2.3 Restrictions on Uploaded Content
You shall not upload, distribute, or publish through this Site any content, information, or material that:
(a) Infringes upon the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any third party;
(b) Is libelous, threatening, defamatory, obscene, indecent, pornographic, or otherwise violates applicable U.S. or international laws and may give rise to civil or criminal liability;
(c) Contains viruses, worms, Trojan horses, trap doors, or any other harmful code, files, or programs that may damage or disrupt the Site or users’ devices.
2.4 Account Responsibilities
Flishrc may assign to you a unique password and account identifier to enable access to restricted portions of the Site. Each use of such password or identifier shall be deemed as authorized access consistent with the terms of this Agreement. Flishrc has no obligation to verify the authorization or source of any access or use of the Site via such credentials.
You shall be solely responsible for all activities conducted through your account, whether authorized by you or not. This responsibility includes all communications, data transmissions, and obligations (including financial obligations) incurred via your account.
You are solely responsible for maintaining the security and confidentiality of your password and account identifier. You must immediately notify Flishrc of any unauthorized use of your account, or any suspected breach of the Site’s security.
3. Reviews and Comments
3.1 Treatment of Submissions
Except as otherwise provided in this Agreement or on the Site, any content you submit, post, or provide to Flishrc (including but not limited to ideas, know-how, techniques, questions, reviews, comments, and suggestions, collectively referred to as “Submissions”) shall be treated as non-confidential and non-proprietary.
By submitting or posting any Submission, you irrevocably grant Flishrc a royalty-free, worldwide, perpetual, irrevocable, and transferable license to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, and create derivative works from such Submissions in any form or by any means. This license covers all intellectual property rights associated with the Submissions, excluding moral rights such as the right of authorship.
All Submissions shall automatically become the sole and exclusive property of Flishrc and will not be returned to you. You agree not to assert any claims or raise any disputes against Flishrc regarding its use of your Submissions.
3.2 Warranties and Indemnification
You warrant that your Submissions, in whole or in part, are original, clear, and free from any intellectual property infringement, disputes, or third-party claims.
Flishrc shall not be liable for any misuse of copyright or other third-party rights arising from your Submissions. You agree to defend, indemnify, and hold Flishrc harmless from any and all losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) incurred due to your Submissions.
3.3 Additional Provisions for Reviews
In addition to the rights outlined in Section 3.1, when you post reviews or comments on the Site, you grant Flishrc the right to use the name submitted with such content in connection with the display and distribution of the relevant reviews or comments.
You represent and warrant that you own or have the legal right to control all content posted on the Site, and that Flishrc’s use of such content will not infringe upon the rights of any third party.
You shall not use a false email address, impersonate any person or entity, or otherwise misrepresent the origin of any Submissions or content.
Flishrc reserves the right, but is not obligated, to remove or edit any Submissions (including reviews and comments) at its sole discretion, for any reason whatsoever.
4. Copyright
All text, graphics, photographs, images, button icons, audio clips, logos, slogans, trade names, software, and other content available on the Flishrc Site (collectively referred to as “Content”) are the exclusive property of Flishrc or its authorized content suppliers.
Without Flishrc’s express prior written consent, you shall not use, reproduce, copy, modify, transmit, display, publish, sell, license, publicly perform, distribute, or commercially exploit any Content, nor dispose of any Content in a manner not expressly permitted by Flishrc.
The use of data mining, robots, spiders, or similar automated data gathering and extraction tools on the Site is strictly prohibited. The use of Flishrc’s trademarks or service marks in meta-tags is also prohibited.
You may view and use the Content solely for personal, non-commercial purposes, including browsing for information and placing orders on the Site. No other use is permitted.
